Terms of Service

1. Who can use Cherrywish

You must be at least 13 years old, or the minimum age of digital consent in your country if that is higher, to create an account. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms. Recipients of a gift do not need an account to view it.

2. Your account

You can sign up with an email address and password, or with Google. You’re responsible for keeping your login details secure and for all activity on your account. Tell us immediately at info.zetrone@gmail.com if you think someone else has accessed your account. You must give accurate information when signing up.

3. What the Service does

Cherrywish lets you create digital gifts, including free e-cards, free interactive gifts and paid premium templates. You can personalise them with photos, messages, music and other content, and share them by email, link or QR code. We may add, change or remove features or templates at any time.

4. Your content

“Your Content” means anything you upload or add to a gift, including photos, text, audio and recipient details.

• You own it. You keep all ownership rights in Your Content.
• Licence to us. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process and display Your Content only as needed to run the Service. This includes showing your gifts to the people you share them with. The licence ends when you delete the content, except for copies kept briefly in backups or where the law requires us to keep them.
• Your promises. You confirm that you own Your Content or have all the permissions needed to use it, including permission from people who appear in your photos, and that it doesn’t break any law or anyone’s rights.

5. Music and copyrighted material

You may upload music and other audio. You are solely responsible for making sure you have the right to use any music or material you upload. We do not check uploads, and we are not responsible for content that users upload. You agree to indemnify us (see section 13) against claims arising from content you upload without the necessary rights.

Copyright complaints. If you believe content on Cherrywish infringes your copyright, email info.zetrone@gmail.com with:

• your contact details
• a description of the copyrighted work
• the link to the content you believe infringes it
• a statement that you believe in good faith the use isn’t authorised
• a statement that your notice is accurate, made under penalty of perjury
• your physical or electronic signature

We will remove or disable access to content where appropriate. We may close the accounts of repeat infringers.

6. What you can't do

You must not use the Service to:

• upload content that is illegal, sexually explicit, hateful, harassing, violent, or that exploits or harms minors
• impersonate anyone or send gifts meant to deceive, defraud or harass someone
• upload private images of people without their consent
• send spam or unsolicited bulk messages
• upload malware, or try to hack, overload, scrape or reverse-engineer the Service
• resell or commercially exploit our templates outside the Service without permission

We may remove content or suspend or terminate accounts that break these rules, with or without notice.

7. Sharing gifts

Anyone who has a gift’s link or QR code may be able to view it, unless you add a lock. You’re responsible for who you share links with. Locks add privacy, but no method is completely secure.

8. Templates and our content

Our templates, designs, illustrations, code, branding and other materials belong to us or our licensors. You may use them only to create and share gifts through the Service.

9. Payments

• Premium templates are sold as one-time purchases. Prices are shown in US dollars (USD) on each template before you buy. There are no subscriptions.
• Payments are processed by Lemon Squeezy, which acts as the merchant of record for your purchase. Lemon Squeezy’s terms and privacy policy also apply to your payment. We do not receive or store your full card details.
• Taxes may be added at checkout depending on your location.

10. Refunds

• No refund once a gift has been sent, meaning shared by email, link or QR code.
• Refunds within 30 days of purchase if the premium template hasn’t been used to send a gift, or if a technical problem on our side stops it from working and we can’t fix it.
• To request a refund, email info.zetrone@gmail.com with your order details. Approved refunds are issued through Lemon Squeezy to your original payment method.
• This doesn’t affect any rights you have under consumer protection laws in your country.

11. Storage, deletion and inactive accounts

• Your gifts and content stay stored for as long as your account is active, until you delete them.
• You can delete individual gifts, or your whole account, at any time. Deleted gift links will stop working.
• If an account is inactive (no sign-in) for more than 5 years, we may delete it and its content. We’ll try to email you 30 days beforehand.
• You can also close your account at any time. We may suspend or terminate accounts that break these Terms.

12. Disclaimers

The Service is provided “as is” and “as available”. We don’t guarantee it will always be available, error-free or secure, or that content will never be lost. We recommend keeping your own copies of important photos. To the extent the law allows, we disclaim all implied warranties.

13. Indemnity

You agree to cover any losses, claims or costs (including reasonable legal fees) that we face because of Your Content, your misuse of the Service, or your breach of these Terms.

14. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill. Our total liability for any claim related to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 50. Nothing in these Terms limits liability that cannot legally be limited.

15. Changes to these Terms

We may update these Terms from time to time. If changes are significant, we’ll notify you by email or on the site before they take effect. Continuing to use the Service after that means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of Sri Lanka, and disputes will be handled by the courts of Colombo, Sri Lanka. If you live in the EU, UK or another country with mandatory consumer protection laws, you keep those protections and may bring claims in your local courts.
